PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 7 April 2000, HQ, Tennessee Army National Guard (STARC), Houston Barracks, PO Box 41502, Nashville, TN, Orders 098-293 discharged the applicant from the Army National Guard, effective date 31 March 2000. The record contains a properly constituted NGB Form 22 (Report of Separation and Record of Service). His NGB Form 22 indicates that he was discharged under the provisions of Chapter 13, AR 135-178 & paragraph 1-26k by reason of unsatisfactory participant, with a characterization of service of general, under honorable conditions. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 31 March 2000, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, and 6 days of active military service.

Legal/Regulatory Basis for Separation Action : National Guard Regulation (NGR) 600-200 and Army Regulation 135-178 govern procedures covering enlisted personnel of the Army National Guard. Chapter 13 of AR 135-178 covers, in pertinent part, discharge and separation of enlisted personnel for misconduct due to unsatisfactory participation. Army Regulation 135-91 states that a member is an unsatisfactory participant when nine or more unexcused absences from scheduled drills occur during a 1 year period. An enlisted member separated for misconduct which includes unsatisfactory participation will normally be furnished a characterization of service of under other than honorable conditions in accordance with Army Regulation 135-178.

(1) The issue is rejected. The evidence of record available to the Board shows that the applicant was discharged from the Army National Guard under the provisions of Chapter 13, AR 135-178 & paragraph 1-26k, by reason of unsatisfactory participation with a character of service of general, under honorable conditions. Barring evidence to the contrary the Board presumes administrative regularity in the discharge process. The Board noted the applicant’s contentions; however, the Board determined that the applicant had many legitimate avenues through which to obtain assistance or relief, without committing the misconduct, which led to the separation action under review. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
